Nevada Rest Break Requirements

Nevada requires employers to provide a paid 10-minute rest break for every 4 hours of work, or major fraction thereof. The rest break must be provided as close to the middle of the 4-hour work period as practicable. Rest breaks are counted as hours worked and must be compensated.

Description
A paid 10-minute rest break must be provided for every 4 hours of work or major fraction thereof. The break should be scheduled near the midpoint of each 4-hour period.

Penalties

Employers who fail to provide required rest breaks may face enforcement action by the Nevada Labor Commissioner, including fines and orders to comply.

Notes

Nevada's rest break requirement is similar to those in California, Colorado, and Washington. The 'major fraction thereof' language means that work periods of more than 2 hours beyond a multiple of 4 trigger an additional rest break. Rest periods are paid time and may not be combined with meal breaks or used to shorten the workday.
